New Ethics Charges For Nifong

JANUARY 24--Mike Nifong, the embattled North Carolina district attorney who recently stepped down from the Duke rape case, was hit today with new ethics charges related to his botched handling of the prosecution of three lacrosse players. In an amended complaint, the North Carolina State Bar accuses Nifong of withholding DNA evidence and then lying about it to judges and the bar itself. Today's action adds new charges to a December 28 complaint accusing Nifong, 56, of making numerous press statements that were prejudicial and engaging in 'conduct involving dishonesty, fraud, deceit, or misrepresentation.' The new complaint, an excerpt of which you'll find below, alleges that Nifong withheld potentially exculpatory DNA evidence from defense counsel and then filed court papers denying knowledge of such evidence. During one hearing about discovery, the complaint notes, Nifong told a judge, 'I've turned over everything I have.' That statement (and various others) were characterized by bar investigators as 'misrepresentations and false statements.' He is also charged with knowingly 'making false statements of material facts' in responses he recently provided to the bar in connection with the ethics charges. Nifong, who could be stripped of his law license due to the charges, is scheduled to appear today before the bar group. (18 pages)
